By Associated Press

A federal jury has begun deliberations in a civil trial of South Korean pop star and actor Rain and his managers over the cancellation of his scheduled 2007 concert in Honolulu. Hawaii-based Click Entertainment Inc. alleges Rain and his agency breached a contract and defrauded it of $500,000 in rights fees, plus nearly $1 million in other expenses to stage the event.
The four-man, three-woman jury began deliberating Wednesday morning to determine if and how much damages should be awarded.

Sad

19 Mar 2009 - Jury finds Rain liable for $8.086M in damages for canceled Hawaii concert

Korean entertainer Rain and his management company committed fraud and breach of contract when he abruptly canceled a 2007 concert here and must pay $8.086 million in damages to the event’s promoter, a federal court jury decided this morning.

The jury found Rain personally liable for more than $3 million of the award and his management company, JYP Entertainment Co., Ltd., responsible for most of the rest.

Two other promoters, StarM Entertainment and Revolution Entertainment, which did not defend themselves in the suit, were found liable for some $500,000 of the total award.

Attorney Eric Seitz, who represented plaintiff Click Entertainment and its owner, Seong Su Lee, said outside court he will move to collect the judgment as soon as possible.

“He’s a very talented young man and I’m sorry he got caught up in this,” Seitz said of Rain, whose real name is Jung Ji-Hoon.

But the jury found that “there was a fraud perpetrated for a long time and continued to be perpetrated right up to the trial,” Seitz said.

He said if the entertainer resists paying the judgment, he risks “losing his career because nobody will touch him.”

The attorneys for Rain left the courthouse without commenting on the verdict.

19 Mar 2009 - Jury rules against South Korean star for $8M

HONOLULU (AP) — South Korean pop star and actor Rain and his managers on Thursday were ordered to pay a Hawaii promoter more than $8 million in damages for canceling a 2007 concert in Honolulu.

A federal jury found Rain, his agency JYP Entertainment Co. and two South Korean promotion companies breached a contract to perform and defrauded Click Entertainment Inc.

Nearly $5 million was for punitive damages, with Rain and JYP each ordered to pay $2.4 million. An additional $1 million was awarded for damages related to the fraud and $2,286,000 was given for breach of contract.

“That was the best we certainly could’ve hoped for under the circumstances,” Click attorney Eric Seitz said. “I hope they send a message that people can’t do the kind of things that this entertainer and his agents did. I think he received very bad advice. … The decisions here were just horrible.”

The judgment is expected to trigger several lawsuits across the United States where the star abruptly canceled shows two years ago. A similar lawsuit was recently filed in Los Angeles, where Rain’s concert at the Staples Center was scratched a couple hours before show time.

“We’re obviously very disappointed with the jury’s decision in this matter,” Rain’s lead lawyer, Jon Crocker, said. “We maintain our position that both JYP and Rain fulfilled all their obligations with regard to the Hawaii performance. We will continue to vigorously defend them, wherever these promoters bring these baseless lawsuits.”

Rain’s concert was canceled just days before the scheduled June 15, 2007, event at Aloha Stadium, where tickets were sold for as much as $300 each. It was supposed to be the first stop on the “Rain’s Coming” U.S. tour.

The jury reached the verdict Thursday after deliberating for more than a day.

Click President Seung Su Lee testified that he lost nearly $1.5 million because of the cancellation, which also damaged his business reputation. He argued that Rain and his traveling entourage of 90 people never intended to perform in Hawaii, saying the crew never applied for proper visas or shipped their equipment.

Rain — whose real name is Jung Ji-hoon — testified for 90 minutes, saying he had every intention of performing and that he had no hand in the cancellation.

Crocker argued the contract Lee had was not with Rain or JYP. It was with a company named Revolution Entertainment, owners of the North American rights to Rain’s concerts, he said.

The lawyer also said a proper stage wasn’t created for the star in addition to Rain being unable to use his name in the United States because of a copyright challenge from a Beatles tribute band named Rain.

The 26-year-old Rain is widely popular across Asia where his smooth dance moves have earned him the nickname “the Justin Timberlake of Asia.” He also gained popularity for his roles in Korean TV drama series.

In 2006, Time magazine named him one of 100 most influential people in the world.

Rain has been dabbling in Hollywood in recent years. He is scheduled to appear in a leading role in the upcoming action film “Ninja Assassin,” directed by James McTeigue and co-produced by the Wachowski brothers. Rain made his Hollywood debut last year in a supporting role in the brothers’ film “Speed Racer.”

19 Mar 2009 - [KHNL] Korean pop singer ‘Rain’ to pay $8M for canceling Hawaii concert

Updated: March 19, 2009 04:35 PM

HONOLULU (KHNL) -  Korean pop sensation Rain had a dark cloud over his head.  A federal jury ruled Thursday morning he and JYP Entertainment, his management team, have to pay more than $8 million for abruptly canceling his Hawaii concert almost two years ago.

Rain, whose real name is Jung Ji-hoon, was scheduled to kick off his U.S. tour at Aloha Stadium back in summer of 2007. That never happened, and Hawaii-based Click Entertainment, Inc., says the singer breached a contract, causing the company to lose $1.5 million in concert related expenses.

“I hope they sent a message that people can’t do the kinds of things that this entertainer and his agents did,” said Eric Seitz, an attorney representing Click Entertainment.  “I think he probably received very bad advice. I don’t hold him personally responsible in that he testified that he relies on other people to make decision for him but the decisions were horrible.”

The seven-person jury deliberated for just a day before handing out its verdict.

“I have to commend the jury,” said Seitz. “I think they listened carefully and they did an excellent job. I mean the verdict was over $8 million.”

A Click Entertainment executive says Rain never made any attempt to resolve the matter or even issue an apology to his fans in Hawaii.  A similar lawsuit is pending in Los Angeles, where he also failed to perform.  Rain also canceled concerts in New York, Toronto, San Francisco and Atlanta in 2007.

19 Mar 2009 - Jury Rules Singer Rain, Management Owe $8 Million
Lawsuit Involves Canceled 2007 Aloha Stadium Concert

POSTED: 11:37 am HST March 19, 2009
UPDATED: 12:15 pm HST March 19, 2009

HONOLULU -- A federal jury on Thursday awarded a local promoter $8 million in a lawsuit filed against Korean pop singer Rain.

The jury found that the popular singer made fraudulent statements knowing that the local promoter was relying on him to hold a concert at Aloha Stadium even after it was canceled.

Local promoter Click Entertainment sued Rain, whose real name is Jung Jihoon, and his former management company for canceling an Aloha Stadium concert slated for June 2007.
Click here to find out more!

The jury awarded the promoter $2.286 million in actual damages, $1 million for fraud, $2.4 million punitive damage against Rain and another $2.4 million in punitive damages against his management company.

Promoter already won default judgments against two companies who licensed the contracts. Rain and his management company had given the authority to companies Revolution, Star M to act on their behalf.

Click Entertainment had been awarded $2 million from each contracting company. Neither company is in existence, so collecting those awards appears unlikely.

Rain testified in court that he did not know why the concert was canceled and hoped to some day return to perform in Hawaii.

20 Mar 2009 - SKorea's Rain hit with 8 million dollars court judgement
(AFP)

SEOUL – Agents for South Korean star singer and actor Rain said they are consulting their lawyers after a US court ordered them to pay more than eight million dollars for cancelling a concert in Honolulu in 2007.

"This is a result we would never have expected," Jung Wook, president of JYP Entertainment, told Yonhap news agency.

"We will decide our future course of legal action in a few days after discussing it with attorneys who are on their way back (to Seoul)."

On Thursday a Honolulu federal jury found Rain and his agency had breached a contract with Click Entertainment to perform a concert almost two years ago. It ordered them to pay the Hawaiian promoter punitive damages and compensation.

Rain's concert was cancelled a few days before its scheduled date of June 15, 2007 at Aloha Stadium, the first stop on his US tour. The tickets cost a maximum 300 dollars each.

Click Entertainment said the cancellation cost it more than 1.5 million dollars and its business reputation was damaged.

Rain argued that the concert stage was not properly set up for him. He also said he was unable to use his name in the United States because of a copyright challenge from a US Beatles tribute band also called Rain.

The 26-year-old singer, whose real name is Jung Ji-hoon, is one of South Korea's biggest celebrities and has a big following across Asia.

20 Mar 2009 - RAIN ORDERED TO PAY $8 MILLION FOR CANCELLED GIG

Korean pop superstar RAIN has been ordered to pay a Hawaiian concert promoter $8 million (£5.7million) in damages for cancelling a concert in 2007.

A jury on Thursday (19Mar08) found the pop star, his managers and two South Korean promotion companies guilty of breaching contracts linked to a cancelled gig at the Aloha Stadium in Honolulu on June 2007.

A judge ordered the star and his agency, JYP Entertainment Co., to pay a sum of $2.4 million (£1.7million) each, with another $1 million (£700,000) awarded for fraud and an additional $2,286,000 (£1,630,000) for a breached contract.
Rain's lawyer Jon Crocker told reporters, "We're obviously very disappointed with the jury's decision in this matter.

"We maintain our position that both JYP and Rain fulfilled all their obligations with regard to the Hawaii performance. We will continue to vigorously defend them, wherever these promoters bring these baseless lawsuits."

It's not the only suit Rain is facing stemming from cancelling a string of gigs on 2007's Rain's Coming U.S. tour - a Los Angeles promoter is seeking $30 million (£21.4 million) plus punitive damages after the singer called off a show at the city's Staples Center.

Hawaii - Prozess verloren, Schaden 8 Mio. $
Los Angeles - Klage auf 30 Mio. $
New York, Toronto, San Francisco & Atlanta - werden auch bestimmt nicht lange auf sich warten lassen

Mein Rat an Rain:
